Fillmore and Delta DUI Lawyer | Millard County Justice Court DUI Defense

Millard County has justice courtrooms in Fillmore and in Delta, and both cities also have municipal justice courts at those same addresses. The court name on the citation is the difference. Dallin Littlefield defends DUI cases in these courts. You do not drive to Saratoga Springs for the consult.

Two towns, shared doors

Fillmore and Delta each have a city court and a county courtroom.

Millard County Justice Court lists an east courtroom at 765 South Highway 99, Suite 2, in Fillmore, and a west courtroom at 71 South 200 West in Delta. The county says this court handles sheriff, highway patrol, and the other agencies it lists, for Class B and Class C misdemeanors and infractions. That is the court for the towns that do not run a justice court of their own: Hinckley, Oak City, Scipio, Holden, Kanosh, Meadow, and Lynndyl.

Fillmore and Delta are different, because each city also has a municipal justice court. Fillmore City Justice Court lists the same Fillmore address, 765 South Highway 99, Suite 2, and posts sessions on the second and fourth Thursday, by appointment. Delta City's court page lists 71 South 200 West, the same address as the county's west courtroom, and posts court on the first and third Thursday at 9:30 a.m., not counting trials and specially set hearings. Same door, different court name. Appearing for the city when the caption says the county, or the other way around, does not put you on the right calendar.

The geography is why people mix them up. Fillmore is on I-15, the old territorial capitol, and the justice complex on Highway 99. Delta is west, on US-6 and US-50. A stop in Scipio on I-15 and a stop on the highway through Delta can both be Millard County cases, in different courtrooms. A stop inside Fillmore or Delta can be the city court instead. Fourth District Court for the county is also in the Fillmore complex, at 765 South Highway 99, Suite 6. That suite is not the justice court.

Most first-offense DUIs in Utah are Class B misdemeanors handled in justice court. These Millard courts are where that level of case is heard. A DUI charged more seriously, including where there is a prior offense, an injury, or a child in the vehicle, can be filed in district court. Dallin will not tell you to plan around Suite 2 or Suite 6 until he has seen the charging paper. A Carbon County caption, for a stop toward Price on US-6, is a different county entirely.

Fillmore

765 South Highway 99, Suite 2

County east courtroom and Fillmore City Justice Court both use this address. Suite 6, in the same complex, is district court. The caption, not the highway, tells you which door.

Delta

71 South 200 West

County west courtroom and the Delta City court page both list this address. A Delta address on the notice does not, by itself, tell you whether the case is the city's or the county's.

Arraignment in Millard County

The first setting is the charge and your rights.

The posted Thursday calendars are not a substitute for your notice.

  1. Read the court name, then the town

Millard County Justice Court, Fillmore City Justice Court, and Delta City Justice Court are three captions. Two addresses cover them. Bring the paper that says which name you have, and whether the place is Fillmore or Delta.

  2. The court states the charge. You are told your rights.

That includes the right to a lawyer. Pleading not guilty, or asking for time to hire counsel, is a normal way to start. The case is not supposed to be decided in the first few minutes.

  3. Check the link before you drive between Fillmore and Delta

Most hearings at these courts are held virtually or hybrid. Many people attend online instead of giving up a workday or driving I-15 for a short appearance. The court can still require you at Suite 2 or at 71 South 200 West. The notice says which.

The courthouse may be in the other town. The consult is not.

Most hearings at these courts are held virtually or hybrid, so a lot of settings do not require the drive from Delta to Fillmore, or from a farm town to either courtroom. The county also posts a login for a scheduled hearing. Treat a video hearing as court: on time, somewhere you can speak, citation in hand. If the notice says in person, use the town and the suite on that notice. Fillmore City's posted days and Delta City's posted days are the courts' general calendars. Your date can be a special setting.

Littlefield Legal consults by phone or video. The office base is Saratoga Springs, which is the wrong direction for a first conversation about a Millard County case. Utah's license process moves on its own short timeline, separate from this criminal case. You do not need every document in order before you call. You do need the court name.

How a defense is prepared once the caption is clear is on the DUI practice page. If you would rather write than call, use the contact page.
